    Horizontal Application of Fundamental Rights: Can They Apply Between Private Parties?

    Normally hum sunte hain ki Fundamental Rights State ke against enforce hote hain. Lekin modern law ek interesting debate raise kar raha hai: kya yeh rights private parties ke beech bhi indirectly apply ho sakte hain?

    Pure horizontal application ka matlab hota ki aap direct kisi private company, employer, school, hospital ke against fundamental right ka violation ka case la sakte ho. Kai constitutions isko limited sense me accept karte hain – specially jab private entity ka role public function jaisa ho, jaise private universities, private prisons, big utilities, etc.

    Doosra route hai indirect application. Yaha civil courts ya tribunals jab private disputes resolve karte hain – employment contracts, housing discrimination, social media bans – to wo fundamental rights ke principles (equality, dignity, privacy) ko mind me rakhte hain jab statutes ya common law ko interpret karte hain.

    Practical level pe iska impact dikhne laga hai: workplace harassment policies, non-discrimination rules, privacy standards in tech platforms – sab me constitutional values seep kar rahe hain. Exact scope abhi bhi courts shape kar rahe hain, but message clear hai: rights sirf sarkar ke against shield nahi, slowly private power ke against bhi influence create kar rahe hain.
